Search is one of twelve evidence collection procedures as stipulated in the Criminal Procedure Act of the Republic of Croatia, whose goal is to determine facts in a procedure. Considering it is a procedure that touches upon citizens' fundamental rights, it is of utmost importance that the search is done according to regulations. The purpose of the search is finding persons who have committed an offence and objects or traces relevant to the criminal procedure. This study examines the substantive and procedural requirements for conducting a search, types of searches (the search of home and other rooms, the search of a person, the search of movables and safe-deposit box) as well as cases of unlawful search. Additionally, an analysis of relevant practices of domestic courts and the European Court of Human Rights has been conducted, with a special emphasis on the case Lisica vs. The Republic of Croatia.
