Abstract | Tema ovog završnog rada su „Posebne uzance u ugostiteljstvu (1995.) i njihov značaj u hrvatskom pravu“. Posebne uzance u ugostiteljstvu su kodificirani trgovački običaji za poslove ugostiteljskih usluga. One su objavljene u Narodnim novinama Republike Hrvatske od 8.3.1995. godine, br. 16/95 i 108/96. Svrha ovog rada je upoznavanje sa pojmom uzanci i statusom uzanci te Posebnim uzancama u ugostiteljstvu i ugovorima koji su uređeni po njima. U Posebnim uzancama je uređeno šest turističkih ugovora. To su izravni ugovor o hotelskim uslugama, agencijski ugovor o hotelskim uslugama, ugovor o alotmanu, ugovor o smještaju u turističkim apartmanima, ugovor o uslugama kampiranja i ugovor o uslugama prehrane i točenja pića. Cilj ovog rada je prikazati ugovore koje Posebne uzance u ugostiteljstvu uređuju i ukazati na njihov značaj. U radu je korištena induktivna i deduktivna metoda, metoda analize i sinteze i metoda deskripcije. Ovaj rad sadrži uvod, šest poglavlja, zaključak i sažetak. U prvom poglavlju „Uzance“ definiran je pojam uzanci i status uzanci. Dalje se navodi pojam posebne uzance u ugostiteljstvu, njihov sadržaj te opće odredbe. U drugom poglavlju sa naslovom „Ugovor o hotelskim uslugama“ obrađuju se ugovori koji spadaju pod ugovor o hotelskim uslugama, a to su: izravni ugovor o hotelskim uslugama, agencijski ugovor o hotelskim uslugama i ugovor o alotmanu. U cijelom poglavlju se navode i objašnjavaju uzance od 8. do 102. U trećem poglavlju se govori o smještaju u turističkim apartmanima. U ovom dijelu su obrađene uzance od 103. do 116. koje uređuju ovaj ugovor. U tim uzancama je propisana primjena uzanci, oblik ugovora, rezervacija smještaja, predujam, odustanak od rezervacije, trajanje ugovora, lista inventara, zabrane gostu, cijena, jamčevina, raskid ugovora i najam kuća i stanova za odmor. U četvrtom poglavlju je obrađen ugovor o uslugama kampiranja koji sadrže uzance od 117. do 129.. Te uzance se odnose na sklapanje ugovora o uslugama kampiranja, prava i obveze ugovornih strana, uporabu kampa, red u kampu, stvari gosta, raskid ugovora i primjenu uzanci. U šestom i zadnjem poglavlju glavnog dijela se nalazi ugovor o uslugama prehrane i točenja pića. U tom ugovoru su sadržane uzance od 130. do 151., a one se odnose na sklapanje ugovora, predmet ugovora, cijenu usluge, rezervaciju, pružanje usluga, plaćanje usluga, korištenje usluga, pravo ugostitelja, stvari gosta, otkaz usluge i proviziju. Na samom kraju rada je zaključak.
Posebne uzance u ugostiteljstvu su nastale zbog velikog broja subjekata koji su se susretali na turističkom tržištu. Među njima je bilo nemoguće u potpunosti urediti sve odnose propisima i ugovorima između davatelja i korisnika ugostiteljskih usluga. Zbog toga je praksa razvila veliki broj trgovačkih običaja u ugostiteljstvu, čijim su kodificiranjem nastale Posebne uzance u ugostiteljstvu. Značaj Posebnih uzanci u ugostiteljstvu, osim u svakodnevnoj i poslovnoj primjeni, očituje se u tome što su poslije Zakona o obveznim odnosima izvor poslovnog prava u turizmu. Posebne uzance u Ugostiteljstvu olakšavaju poslovanje, smanjuju nesporazume, omogućuju njihovo djelotvorno rješavanje i pridonose unaprjeđenju kvalitete pružanja ugostiteljskih usluga i poslovanja. |
Abstract (english) | The topic of this thesis is „Customary Practices in the Hospitality Industry (1995) and Their Relevance in Croatian Law“. Customary Practices in the Hospitality Industry are codified trade customs observed in the hospitality sector. They were published on 8 March 1995 in the Official Gazette of the Republic of Croatia, No. 16/95 and 108/96. The purpose of this thesis is to provide deeper understanding of the term customary practices i.e. customs and their status, as well as the Customary Practices in the Hospitality Industry and the contracts governed by such customs. The provisions of the Customary Practices in the Hospitality Industry govern six tourism-related contracts. These are the hotel services direct agreement, the hotel services agency agreement, the allotment contract, the holiday apartment accommodation contract, the campsite service agreement, and the food and beverage services agreement. This thesis aims at providing an overview of the contracts governed by the Customary Practices in the Hospitality Industry and identifying their relevance. The research methods used in the thesis were the inductive and deductive method, the analysis and synthesis method, and the descriptive method. The thesis is organized in several sections; the introduction, six chapters, the conclusion, and the abstract. The first chapter „Customs“ provides a definition of the term customs and their status. Moreover, it introduces the term Customary Practices in the Hospitality Industry, their content and general provisions. The second chapter, entitled „Hotel Services Agreement“, explores the hotel-related contracts such as the hotel services direct agreement, the hotel services agency agreement, and the allotment contract. The chapter outlines and explains the customary practices under items 8 to 102. The third chapter elaborates on the contract for accommodation in holiday apartments. This chapter analyzes the customary practices under items 103 to 116, which govern said contract. The above customary practices provide for their application, form of the contract, booking of the accommodation unit, down payment, cancellation of booking, term of the contract, inventory list, rules for guests, price, deposit, cancellation of the contract, and rental of holiday homes and apartments. The fourth chapter outlines the campsite service agreement which includes the customary practices under items 117 to 129. These common practices relate to the conclusion of the campsite service agreement, the rights and duties of the parties, usage of the campsite, the camping rules, personal belongings of guests, cancellation of the contract, and application of the customary practices. The sixth and last chapter of the main section presents the F&B services agreement. Said agreement includes the customary practices under items 130 to 151, which relate to the conclusion of the agreement, subject of the agreement, price, booking, provision of services, payment of services, utilization of services, rights of the service provider, personal belongings of guests, cancellation of the services, and commission. The thesis is rounded up with a conclusion section.
The Customary Practices in the Hospitality Industry have been established due to the large number of parties involved and interacting with one another in the tourism and hospitality sector. It was impossible to fully regulate all the relations among the various stakeholders by regulatory provisions and contracts between providers and users of hospitality services. For this reason, the practice has developed a large number of trade customs commonly used in the hospitality industry, whose codification resulted in the Customary Practices in the Hospitality Industry. Apart from their application in the everyday and business practice, the relevance of the Customary Practices in the Hospitality Industry is demonstrated by the fact that, right after the Civil Obligations Act, they are the source of tourism business law. The Customary Practices in the Hospitality Industry facilitate the business operations, reduce misunderstandings, enable their effective resolution, and contribute to the improvement of the hospitality services quality and the ease of doing business in the hospitality sector. |
