The court record in case describes a borrowing of a bull from one farm to another for the purpose of natural breeding of cows. It is stated that the symptoms of a pulmonary disease were notice already the first day; it was determined that according to the rules of the profession there was no proven nor confirmed suspicion that the bull suffered from bovine rhinotracheitis. Although the plaintiff noticed a problem with other cows after 10 days, we determined that the acute form of infectious bovine rhinotracheitis was officially proven on 17th July 2008, when the staff of Croatian Veterinary Institute took blood and pathogen samples. According to the data of the Veterinary Directorate, the disease was neither reported nor confirmed on the plaintiff's farm in 2008. Whether the defendant implemented statutory measures on his bull cannot be stated with certainty, because the mentioned data from the Directorate cannot serve 30 as a credible document because of the fact, that according to the data, there were no records of the disease on the plaintiff's farm in 2008. However, one of the conditions to issue the certificate of health is the implementation of statutory measures and a confirmed negative result. Colleague veterinarians are aware of that fact and I am certain they would not issue the certificate if the mentioned procedure was not conducted, because otherwise they would be considered perpetrators in a criminal offense. In this case, the predominant opinion is that veterinarians make an oversight because of the fact that when they suspect an infection they do not diagnose it according to professional standards (i.e. take blood samples and send them to CVI) and they do not implement the necessary measures such as imposing isolation, preventing the bull from breeding and so forth. There is no dispute that the bull was slaughtered and that it had to have a health certificate when it was slaughtered. However, there was no such certificate and it cannot be confirmed whether the animal was healthy or if there was suspicion of disease.
