ABSTRACT The procedure related to expulsion and return of foreign citizens and its numerous variations cause an enormous challenge for the officials, who perform the administrative procedure. By a correctly performed administrative procedure there is no guarantee that the purpose thereof will be achieved, because no enforcing mechanism exist. Foreign citizens can purposely stall or hinder returning procedure, and their countries of origin in most cases hardly cooperate with the bodies which perform procedures related to expulsion or return. The member countries and the institutions of European Union have to put constant effort in order to find out new solutions towards keeping trust of their respective citizens regarding asylum and migration policies. Foreign citizens are not only a burden for the host country, they also establish family relations, invest their own capital and therewith they bring added value, they can significantly enrich the local culture and arts too. The expulsion or the return of a foreign citizen is not only an administrative procedure, wherein the decision is made based on the facts according to the law, but it is at the same time a mass of regulations, commitments, exceptions and limitations, wherein the official mas to decide according to the law and in accordance with the principle of proportionality.
