Abstract
Poslovna sposobnost je izraz u pravnom sustavu koji znači dvije stvari: sposobnost imati prava i sposobnost djelovanja po tim pravima. U praksi poslovna sposobnost osigurava da je osoba prepoznata pred zakonom i da može donositi odluke o svom životu, ostvarivati prava, pristupati pravnom sustavu, sklapati ugovore i govoriti u svoje ime. Kako bi osobe s invaliditetom mogle dobiti odgovarajuću potporu, u skladu s njihovom voljom i potrebama nužno bi bilo omogućiti dostupnost niz odgovarajućih mjera. Osobama s intelektualnim poteškoćama podrška bi mogla biti u vidu pružanja informacija jednostavnim jezikom ili lako čitljivom tekstu, objašnjenje različitih mogućnosti na jednostavan način i postojanje pravne potpore kroz sudski postupak lišenja, preispitivanja i vraćanja poslovne sposobnosti.
Abstract (english)
Legal capacity is a judiciary term that means two things: the capacity to have rights and the capacity to act upon those rights. In practice, legal capacity ensures that a person is recognized before the law and can make decisions about his or her own life, exercise rights, access the civil and juridical system, enter contracts, and speak on his or her own behalf. A range of appropriate measures should be available for persons with disabilities to receive adequate support, according to their will and needs. For a person with an intellectual disability, support could include providing information in plain language or easy-to-read, explaining different options and the existance of legal support through judicial proceeding related to legal capacity.
