The author of this thesis analyzes the legal position of the child in the case of divorce, with a particular focus on the legal mechanisms that protect the rights of the child during and after divorce proceedings. Through a historical analysis, the evolution of children's rights is examined, starting from their marginalized position in the past to the modern legal frameworks that ensure a more active and protected role for the child in legal proceedings. The legal framework of the Republic of Croatia is compared with practices in the European Union, highlighting key differences and similarities. The thesis further addresses mandatory counseling and mediation as instruments aimed at minimizing the negative effects of divorce on children. Special attention is given to the process and characteristics of counseling and mediation, including how child visitation is organized in situations where a mediation plan has not been achieved or it is not possible to reach an agreement. The position of the child as a party in the proceedings is considered through an analysis of their legal rights and obligations. The thesis also explores the role of the special guardian for the child, whose task is to protect the child's interests in the proceedings. The role of social welfare institutes in the development and implementation of a joint parental care plan is additionally explained, emphasizing their importance in ensuring that the child's interests are at the forefront throughout the entire process. The author concludes by emphasizing the importance of integrating various legal and social mechanisms to ensure comprehensive protection of the child in divorce situations and suggests improvements in the legislative framework and practice that would further strengthen children's rights.
