Before limiting the right to freedom of movement, it is first necessary to clarify the right to freedom of movement. The right to freedom of movement is one of the historically oldest and most elementary rights. It is included in the Universal Declaration of Human Rights as well as the Convention for the Protection of Human Rights and Fundamental Freedoms. In Croatia, the right to freedom of movement as well as the restriction of this right is regulated by the Croatian Constitution. Freedom of movement, the right to mobility and the right to travel is the concept of human rights which includes the right of individuals to travel from place to place on the territory of the country. They can change their place of residence, leave the country and return to it. The rights enshrined in the Convention for the Protection of Human Rights and Fundamental Freedoms differ according to whether their protection is absolute or subject to permissible restrictions. They also differ in whether their observance can be temporarily derogated from during a state of emergency or not. The right to freedom of movement, it is clear that it is not absolute, and that is one of the rights to which they can place restrictions, if necessary. Restrictions may be imposed which are in accordance with the law and which are necessary in a democratic society for the interests of national security or public order, for the maintenance of public order, for the prevention of crime, for the protection of health or morals or for the protection of the rights and freedom of others.
