Abstract
Nasljedno pravo u objektivnom smislu predstavlja skup pravnih pravila kojima se uređuje sudbina subjektnih prava i obaveza nakon smrti ostavitelja. Nasljedno pravo u subjektivnom smislu predstavlja ovlaštenje određene osobe ili kruga osoba koji imaju pravo stupanja u građanskopravne odnose umrloga. Nasljedno pravo kao pogodan instrument prenošenja i očuvanja vlasničkopravnih odnosa u svakoj pojedinoj društvenoj ali i gospodarskoj formaciji prolazilo je kroz brojne promjene tijekom povijesti. Svaki nasljednopravni odnos se temelji na nužnosti ostvarenja određenih činjenica, pretpostavki i načela nasljeđivanja. Ovim radom se želi prikazati povijesni razvoj nasljednog prava u Republici Hrvatskoj tijekom nekoliko važnih povijesnih razdoblja koji su omogućili razvoj temelja potrebnih za ostvarenje jedinstvenog nasljednog prava.
Abstract (english)
Inheritance law in objective sense is a set of legal rules governing the faith of the successor’s rights and obligations after the death of the testator. Inheritance law in the subjective sense authorizes certain people or circle of people who have the right of entry into civil relations of deceased. Inheritance law as a convenient instrument of transfer and preservation of ownership and legal issues in any given social or economic formation went through many changes throughout history. Each succession relationship is based on the necessity of realization of certain facts , assumptions and principles of inheritance. This paper is showing historical development of inheritance law in Croatia through several historical periods which enabled the development of important foundations for realization of the unique inheritance law.
