Abstract The European Court of Human Rights is a regional, human rights organ that has been headquartered in Strasbourg, France. The Court was established in 1959 with the aim to supervise the enforcement of the European Convention on Human Rights which was drawn up by the Council of Europe. So far the Court has delivered more than 10,000 judgements regarding the alleged violations of the Convention. The Convention itself obligates signatories to guarantee various specific rights, fundamental civil and political freedoms including the right to a fair trial, the right to protection of property and the freedom of expression. It also prohibits unfair and harmful practices.
In 1998 The European Human Rights System was reformed and it eliminated the European Commission of Human Rights, which previously referred some cases to the Court, decided on the admissibility of complaints to the Court and oversaw the friendly settlements. Today, individual applicants can submit their own complains directly to the Court of Human Rights. Submitting an application is not associated with any costs and the applicants can always apply for legal aid to cover the expenses that can appear later in the proceeding. The applications go through two phases: admissibility and merits. The proceedings before the Court are generally in writing. Prior to a decision, the Court will also try to arrange a friendly settlement if possible.
The aim of this paper is to analyse the Court itself, its history, jurisdiction, and structure, as well as the way applications are submitted and the whole proceedings before the Court.
Abstract (croatian) Europski sud za ljudska prava je regionalno tijelo zaštite ljudskih prava sa glavnim sjedištem u Strasbourg-u, u Francuskoj. Sud je ustanovljen 1959. godine i nadzire primjenu Europske konvencije o ljudskim pravima koju je izradilo Vijeće Europe. Sud je do sada donio više od 10.000 presuda vezanih za navodne povrede Konvencije. Konvencija obvezuje potpisnike da jamče različita specifična prava, temeljne građanske i političke slobode, uključujući pravo na pošteno suđenje, pravo na zaštitu imovine i pravo na slobodu izražavanja. Također zabranjuje nepoštene i štetne postupke.
1998. godine reformiran je europski sustav ljudskih prava i uklonio je Europsku komisiju za ljudska prava, koja je prethodno predlagala neke slučajeve Sudu, odlučivala od prihvatljivosti žalbi Sudu i nadgledala prijateljske sporazume. Danas, pojedine žrtve mogu same podnijeti svoje žalbe izravno Sudu za ljudska prava. Podnošenje zahtjeva nije vezano uz nikakve troškove, a podnositelji zahtjeva uvijek mogu podnijeti zahtjev za pravnu pomoć kako bi pokrili troškove koji se mogu kasnije pojaviti u postupku. Prijave prolaze kroz dvije faze: dopuštenost i zakonska prava. Postupak pred Sudom je prvenstveno u pisanom obliku. Prije odluke, Sud će također pokušati organizirati prijateljsko rješenje slučaja, ako je to moguće.
Cilj ovog rada je analizirati sam Sud, njegovu povijest, nadležnost i strukturu. Nadalje rad će prikazati kako se podnose zahtjevi sudu i cijeli postupak pred Sudom.
