Abstract Radni odnos označava društvenopravni odnos između poslodavca i radnika koji se temelji na njihovom sporazumu na temelju kojeg se radnik obvezuje osobno obavljati određeni rad prema uputama i nalozima poslodavca koji mu se zauzvrat obvezuje osigurati potrebna sredstva za rad uz istovremeno poštivanje normi predviđenih zakonom, kolektivnim ugovorom i pravilnikom o radu kojima je reguliran njihov međusobni odnos. U ovom odnosu radnik i poslodavac su asimetrično postavljeni. Poslodavac je onaj koji nosi glavne odgovornosti i snosi rizike poslovanja, dok istovremeno, temeljem gospodarskog i organizacijskog autoriteta, odlučuje o poslovima koji će se izvršavati, uključujući i način postizanja radne učinkovitosti.. S druge strane, radnik može ponuditi samo svoju osobnu sposobnost i profesionalne kvalifikacije. Stoga je gospodarska i organizacijska ovisnost postala glavnom karakteristikom odnosa između poslodavca i radnika. U teoriji radnog prava, bez obzira radi li se o teoretičarima koji zastupaju ekstenzivnu, ili onima koji su za restriktivnu primjenu pojma radnog odnosa, navedenom pojmu većinom se prilazi formalistički. Međutim, radnopravni odnos ne može se poistovjećivati s pojmom ugovora o radu, budući da je samo jedan od oblika zasnivanja radnog odnosa. Sadržaj pojma radnog odnosa može se utvrditi samo iz njegovih bitnih elemenata, a samo djelomično iz ugovorao radu, kao jednog od instrumenata kojim se zasniva radni odnos.
Abstract (english) A work relationship means a social relationship between an employer and a worker based on their agreement on the basis of which a worker undertakes to perform a particular work personally in accordance with the instructions and orders of the employer who in turn is required to provide the necessary means for work while at the same time respecting the norms provided for by law, collective agreement and the rules of work regulating their mutual relationship. In this relationship the worker and the employer are asymmetrically placed. The employer is the one who carries the main responsibilities and carries the risks of doing business while at the same time decides on the tasks to be executed, including on the basis of economic and organizational authority, including the way of achieving work efficiency. On the other hand, a worker can only offer his/her personal ability and professional qualifications. Therefore, economic and organizational dependence has become the main characteristic of the relationship between employer and worker. In the theory of labor law, whether it is about extensively theoreticists, or those who for the restrictive application of the term labor relations, the term is mostly formalistic. However, the right to work can not be identified with the concept of a labor contract, since it is only one of the forms of employment. The content of the concept of employment can be determined only from its essential elements, and only partly from the labor contract, as one of the instruments based on the employment relationship.
