Sovereignity is an eminent legal term, the key term of legal theory, which defines the meaning of the state as a power, or an institutionalized legal system. The notion of sovereignity signifies a transepochal project of transformation of power into power by means of rights, subject to the laws. The problem of the emergence of a modern state can therefore be understood as the problem of forming and finally accepting the notion of sovereignity. This acceptance implies a recognition that in each independent, national political community there is a single highest authority that is founded on the laws, creates the laws and serves as a cohesive element of the whole community. The most important symbol of the sovereign power is its legislative function, thus specifying the area of validity of sovereignty. This is a legal area, the area of a positive law, because the law is a sovereign rule. Although legibus solutus is the legitimate legislator, it does not mean that his authority is arbitrary and unlimited, since it would contradict the notion of sovereignty as a legitimate authority. By virtue of sovereignity, it implies that all citizens are free and formally equal, regardless of their social differences.
