Abstract
Za stečajni postupak kaže se da je izvanparnični postupak s brojnim posebnostima koji zahtijevaju kombinaciju pravila parničnog, izvanparničnog te ovršnog postupka. Sama posebnost stečajnog postupka je osobito izražena u broju i ovlaštenju tijela stečajnog postupka. Novi stečajni zakon u velikoj mjeri drukčije uređuju, osnivaju sastav i vlast. Zakonska rješenja iskazuju jasnu namjeru discipliniranja tijela stečajnog postupka. Uspješnost i funkcioniranje pojedinih zakonski rješenja pokazat će vrijeme kroz njihovu primjenu.
Abstract (english)
For the bankruptcy proceeding it is said that the offense is a procedure with numerous specialties which require a combination of civil, non-judicial and enforcement proceedings. Alone the particularity of bankruptcy proceedings is particularly pronounced in the number and authority of the bankruptcy proceedings. The new bankruptcy law regulates to a great extent differently, establish the composition and power. Legal solutions express a clear intention to discipline the bankruptcy proceedings. The success and functionality of certain legal solutions will show the time through their application.
