Adoption is a special form of family law care and protection of a child without adequate parental care, which creates a lasting relationship between parent and child. For a child to be adopted, certain preconditions must be met; those on the side of the child that is going to be adopted, and those on the side of adoptive parents. On the child’s side, these norms are are called passive adoptive ability and refer to the age of the child, the exclusion of an adoption by a relative or legal gurdian and the prevention on the adoption of a child of a minor parent. Norms on the part of the adoptee refer to the age, status and citizenship and are called active adoptive ability. Every assumption on the part of the adoptee is accompanied by an interesting openended question, furthermore some experts' opinions about abrogation of upper age limit of an doptee as assumption for adoption, adoption by same-sex couples and international adoption are presented in this paper. The basic principle for adoption is certainly the best interest of the child and this is question that is often difficult to answer because it depents on various circumstances.
