The regulation of the acquisition and possession of weapons by citizens in the Republic of Croatia has been changing and evolving under the influence of political and social changes in the last couple of decades. Administrative procedures conducted based on the provisions of the Law on the Acquisition and Possession of Weapons by Citizens do not differ in essentials from the provisions of the Law on General Administrative Procedure. The most common administrative procedures are the issuance of authorization for the acquisition of weapons and confiscation of weapons. In the process of issuing authorization for the purchase of weapons, the request is submitted to the locally competent police department or station, which decides on the basis of facts gathered through the investigation, inspection of official records and other methods of gathering evidence in the examination procedure. The Ministry of the Interior, through the police department or police station, will confiscate the weapon from its owner if the same person ceases to meet any of the conditions for issuing a permit for the acquisition of weapons. The procedure is initiated ex officio. Legal protection is ensured by initiating an administrative dispute at the competent administrative court. The practice of the administrative courts and the High Administrative Court of the Republic of Croatia regarding the application of the Law on the Acquisition and Possession of Weapons by Citizens mainly refers to the confiscation of weapons or the denial of approval for the acquisition of weapons due to initiated criminal or misdemeanor proceedings. The regulation of the acquisition and possession of weapons by citizens is mostly applied in the procedures for the acquisition and registration of weapons for the purpose of engaging in hunting or some other sports category. As a rule, people who engage in these sports categories are relatively well acquainted with the legal provisions of this area of regulation, and it does not follow from this that the legal and conscientious possession of weapons represents a threat to the safety of society as a whole. Possible shortcomings exist in the application of legal regulations and primarily relate to the proper implementation of administrative procedures. More attention should be paid to keeping detailed and up-to-date records and mutual exchange of information between the bodies that cooperate during the implementation of the procedure.
