This paper presents the legal framework of liability for damages as a very important aspect of sports law in the Republic of Croatia. The rapid development of sports activities, results, and goals has led to an increased risk for all participants, not only for those actively involved in sports but also for spectators at sporting events. The risk of sports injuries is greater than ever, as is the potential damage that can affect all those connected to sports. Therefore, everyone involved in sports, from athletes to organizers, spectators, referees, coaches, and others, is exposed to the risk of harm. Although the Sports Act is quite comprehensive, it does not regulate liability for damages, which is why the provisions of the Civil Obligations Act are applied. However, sports have many specificities that make the provisions of the Civil Obligations Act not always appropriate, and they must be interpreted carefully. When the Civil Obligations Act was enacted, sports law and the specificities of liability in this area were certainly not the primary focus. Therefore, this paper somewhat critiques the current liability framework and highlights the need for changes to the existing legal structure, suggesting that the Sports Act should be expanded to include provisions on liability for damages.
