The current Law on foreigners regulates the issues of documents, entry and exit of third-country nationals, their residence, employment status, as well as measures to ensure return. Foreigners enjoy fundamental human rights in every state in which they find themselves. Nevertheless, each state has the right and interest to regulate these fundamental rights in the way that suits it best in accordance with its legislation. In doing so, certain international norms must be adhered to. Thus, the issue of foreigners in the Republic of Croatia is regulated not only by the Foreigners Act but also by various additional regulations, ordinances and protocols. The most important role in regulating the issue of foreigners is played by the Ministry of the Interior, which is authorized to act on foreigners and regulate their legal issues. Here, the emphasis is on police administrative law, which performs administrative and professional, as well as inspection tasks whose purpose is to establish and regulate the status of foreigners in the Republic of Croatia and thus protection if certain norms are violated. Conditions for entry, stay and exit of foreigners are prescribed by law. The Republic of Croatia shall arrest any person who is illegally present in its territory, whether he entered illegally or entered legally, but whose permitted period of stay has expired. Also, every person has the right to leave the Republic of Croatia freely, respecting the exactly prescribed conditions. The aim of this paper is to analyze the main institutes that regulate the issue of foreigners in the Republic of Croatia and explain them in more detail, but also to define the basic concepts related to foreigners and their rights.
