In the past, a lease on an appartment was an integral part of the lease agreement. It is only at a late stage in the development of this legal area that its separation occurs. According to our legislation it ocurred by 1996, during the adoption of the Law of appartment lease, which is in relation to the previous regulation through the General Obligation Law lex specialis. It is a contract that obliges the landlord to hand over a certain thing to the tenant while the tenant commits, in return, to pay a certain amount of rental charge to the landlord. It can be concluded for a fixed or indefinite period of time, and in terms of format requires a written form. In terms of rent, we distinguish between freely agreed rent and protected rent. Similarly, our Law is known to the protected tenant institute, which has recently undergone major changes that go towards protecting landlords, but with the much-needed balance of protecting the rights of both sides. The tenant also has the opportunity to sublet the apartment with the prior consent of the landlord. It was analyzed how Austrian and German legal systems regulate renting an apartment and, in certain parts, a link to our legal system was made. When discussing the selected topic, special attention was given to the problem of renting an apartment from a student's perspective, as well as to all the problems they encounter during renting.
