The object of this paper is the legal institute of real-estate liens which is used in the current legal system of the Republic of Croatia. The topic was chosen considering the circumstances that due to the ever growing development of the legal relations related to real-estate and with the system of public landowner records are also developing the relations of real estate liens constituted in those records. The methods that were used in writing this paper are the historical analysis of real-estate lien on the territories consisting of current Republic of Croatia, the analysis and comparison of the legislation and the recent judicial practice related to the object of the paper in the Republic of Croatia as well as the analysis of the judicial practice of the Court of justice of the European Union in regards to the questions of real-estate liens. The conclusions that were reached during the writing of this paper detail and relate firstly on the historical dimension and foundation of liens as rights in use since early historical times, through the medieval times, the new age and the modern age of state development and law evolution concluded with the present situation in the Republic of Croatia. As next the conclusions extrapolated from the legislation and judicial practices exemplify the legal frame and facts which are of decisive importance for the correct application of real-estate liens as well as insight into the court’s viewpoints on questions in which there are doubts about their correct applications. Lastly the conclusions from modern efforts of unifying the legal systems of proprietarily defining rights in the sense of better networking of databases of property information, as well as more efficient ways of administrating requests and the fairly recent judicial practice of the Court of justice of the European union point to a direction and ways with which the questions of real-estate liens will be dealt with and solved in the future.
