The subject of this paper is the legal principle of adverse possession as one of the means of acquiring subjective real rights in the Republic of Croatia. The adverse possession is defined as an acquisition of a certain property right based upon its continuous uninterrupted execution during the time period that is precisely set by the law. In the positive legislation of the Republic of Croatia this legal principle is regulated by the Act on Ownership and Other real Rights which determines that only certain real rights can be acquired by the adverse possession, those being ownership and servitude rights. The prevailing part of this paper is dedicated towards a special elaboration of legal presumptions and effects of acquiring those two real rights through adverse possession, as well as towards a review on judicial practice related to that matter. Apart from that, the paper also includes the interpretation of some specific questions regarding the acquisition of ownership rights by adverse possession on real estate that was under public ownership, as well as the question of tabular adverse possession. Numerous acts, professional literature and scientific articles in magazines and books have been used in order for the subject of this paper to be well and thoroughly approached.
