The subject of this thesis, defence rights in criminal proceedings, will pay special attention to the minimal defence rights provided in the Criminal Procedure Act and all in the light of European standards. Besides the aforementioned Act this thesis will also focus on the Constitution, the Convention for the Protection of Human Rights and Fundamental Freedoms, various directives, the practice of the European Court of Human Rights and the practice of domestic courts. The aim of the thesis is to clarify the minimum legal protection provided for in the Convention, following the Criminal Procedure Act, in order for the defence to provide the most favorable facts and to avoid the violations previously established before the European Court of Human Rights. Over the last few years there has been a growing change in the world of law, legal systems are changing both in the Republic of Croatia and in other countries. It is neccessary to demonstrate and explain defence rights so that the defendant can get the best possible legal help and avoid the violation of his basic rights and fundamental freedoms in criminal proceedings. Considering the latin phrase ignoratio iuris non excusat, it is expected that attorneys know the basic rights and fundametal freedoms and be on constant alert regarding possible changes and produce the best possible outcome for their defendant.
