The purpose of this paper is to give a general overview of the electoral system and its elements as a means of realizing democracy with special emphasis on the electoral system of the United States of America. Due to their specificity, but also the fact that the United States is considered a leading world power, it is necessary to understand how the democratic process of elections for the highest positions in the federation is organized and how it functions. The paper deals with types of elections and electoral systems, types of voting rights, the importance and challenges that the state faces when determining the boundaries of electoral districts, etc. Special emphasis is placed on the ways in which states determine election results. I also give a detailed description of the majoritarian and proportional system of determining election results. The central part of the thesis is about the electoral system of the United States of America and the elections for the Congress of the United States of America, that is, for the House of Representatives and the Senate. A special overview is given of the way presidential elections are conducted, and I provide an interpretaton of the the concept and the way of functioning of the electoral college. Finally, the paper points out the problems faced by the American electoral system, but also proposes arrangements that the Republic of Croatia could draw from the American experience and possibly introduce to its law.
