Historically, strike presents institute which was crucial in development of Labor Law, which was designed and implemented as a means of minimizing the consiquences of the actual superiority of employers toward workers in employment. Numerous achivements of the trade union and socalist struggle of 20th century were achieved through strike as the fundamental means through which workers pursued their interests. The right to strike is generally recognized as an integral part of collective bargaining and at the same time as one of the most important ways of how workers keep their socio‐economic rights. In the Republic of Croatia, the right of strike is guaranteed by the Constitution and is included in the Labor Lagislation system of RH through the Labor Law and collective agreements, but also through international documents binding on the RH. The law prescribes preconditions which must be fulfilled in order for an organized strike to be considered legal. The assumptions that must be fulfilled in order for strike to be considered legal are listed in detail. Specifically about these assumptions and the cases of their non‐fulfillment and in general about the legal consequences of participation, whether in a legal or illegal strike, I will write in my work.
