Plagiarism is one of the ways of violating subjective copyright, and represents "theft of authorship." In addition to criminal and misdemeanor law consequences, plagiarism also produces civil law consequences, which is also the central topic of this paper. In this paper, plagiarism is observed primarily from the sphere of legal consequences it produces based on the norms of civil law, and the instruments that the legal regulations of a civil law nature assign to the author of the work, in order to protect his interests regarding his work against plagiarism. Considering the abstractness of art, it is of particular importance to determine which are the smallest building elements of a work that are considered original, and accordingly enjoy legal protection. The concepts of originality and inspiration will also be analyzed, and where the boundary for their demarcation is located. Of the procedural norms, the emphasis was placed on the analysis of the norms regulating the role of the expert in the procedure. Scientific methods used during the writing of the paper have been: classification method, analysis and synthesis method, induction and deduction method, proof and refutation method.
