State aid is a form of state intervention, with the aim of encouraging some economic activity, sector or enterprise. They distort competition because they create discrimination between the recipients of aid and those acting on the market without State aid (Commission of the EC, 2002). But what does it mean to distort competition? The market criterion in the evaluation distorts some competition support: competition is distorted if no market participant wants to invest in the same amount with the same measures in companies supported by the state. Thus, with its state aid, the investment flows into those branches and companies to which private investors do not invest. State aid, regardless of its form, generally means any aid granted by national public authorities to certain companies (economic operators). This type of support is not interoperable with the internal market if it distorts competition and affects trade, unless otherwise provided by the Treaties. Support programs need to be monitored and therefore, in accordance with Article 108 (3) of the UFEU, Member States are obliged to notify the Commission in advance of each plan for granting such aid. By adopting the "Authorizing Regulation", the Council allowed the Commission to establish exemptions (by issuing a Common Exemption Regulation on State Aid), thereby fixing specific categories of State aid that are considered to be interoperable with the internal market and which need not be reported to the Commission beforehand.
