Sažetak | Koncesija u jezičnom smislu predstavlja dozvolu, povlasticu odnosno dopuštenje. Pravno
značenje riječi koncesija predstavlja dozvolu za obavljanje neke djelatnosti uvjetovana
posebnim odobrenjem, odnosno “akt vlasti kojim se obavljanje neke djelatnosti koje je inače
zabranjeno dozvoljava”. Koncesije su dvostrani pravni odnosi, što znači da se uvijek razvijaju
između dviju strana, odnosno između davatelja koncesije i koncesionara. Budući se radi o
dvostranom pravnom odnosu koji je uređen pravom, iz toga odnosa proizlaze određena prava
i obveze za svaku od strana tog odnosa. Razlikuju se tri vrste koncesija, a to su: koncesija za
gospodarsko korištenje općeg ili drugog dobra, koncesija za javne usluge, te koncesija za
javne radove.
Prije dodjele koncesije trebaju se provesti pripremne radnje za davanje koncesije, odnosno
bitno je imenovati stručno povjerenstvo za koncesiju, procijeniti vrijednost koncesije, izraditi
dokumentaciju za nadmetanje, izraditi studije opravdanosti davanja koncesije ili analize
davanja koncesije. Da bi se zasnovao koncesijski odnos, potrebno je, pored odluke o
koncesiji, sklopiti ugovor o koncesiji kojim se određuju prava i obveze davatelja koncesije i
koncesionara. Davatelj koncesije dužan je kontinuirano nadzirati rad koncesionara i
izvršavanja njegovih obveza iz ugovora o koncesiji. U Republici Hrvatskoj se, uz Zakon o
koncesijama, primjenjuju i drugi propisi, kao što je Zakon o pomorskom dobru i morskim
lukama, što će biti predstavljano u ovom radu. Republika Hrvatska je krajem 2012. godine
prilagodila svoje propise o koncesijama novom okviru Europske unije. Koncesije se sada
daju sukladno pravilima o javnoj nabavi, a u velikoj mjeri su povezane i s modelom javnoprivatnog
partnerstva. |
Sažetak (engleski) | A concession in linguistic terms is a permit, a privilege or a permit. The legal meaning of the
word concession is a license to practice an activity subject to a special authorization, that is,
"an act of government authorizing the performance of an activity that is otherwise
prohibited." Concessions are bilateral legal relationships, which means that they always
develop between the two parties, that is, between the concession grantor and the
concessionaire. Since this is a two-way legal relationship governed by law, certain rights and
obligations arise for each of the parties to that relationship. There are three types of
concessions, namely: a concession for the economic use of a common or other good, a
concession for public services, and a concession for public works.
In legal terms, the concession as a license to carry out some activities conditional on special
authorization, and the concession bilateral legal relations, which means that they always
develop between the two parties, ie between the concession grantor and the concessionaire.

law is needed before granting concessions preparatory actions, and preparatory work in
particular: the appointment of the expert commission for concessions, making a concession
justification study or analysis of the concession award, estimated value of the concession, and
preparing tender documents. To devised concession relationship, it is necessary, in addition
to the decision on the concession contract on concession outlining the rights and obligations
of the concession provider and concessionaire. The concession grantor shall continuously
monitor the operation of the concessionaire and the execution of its obligations under the
concession agreement. In Croatia, with the Concessions Act, apply and other regulations,
such as the Law on Maritime Domain and Seaports, which will be presented in this paper. |
