According to the Companies Act, a trading company is a legal person whose establishment and organization are defined by the same law. Two types of companies, for - profit corporation and non - profit corporation, are included in the companies. For – profit corporation establishes one or more physical and/or legal persons by linking or associating their roles they form capital. A joint stock company is a trading company in which members, shareholders, participate in shares in share capital divided into shares. Today, there are about 1500 stock companies in the Republic of Croatia whose share capital is divided into shares and represents a kind of guarantee that the joint stock company has a minimum of this capital. In addition to money, rights can also emerge as a stake in society, from which we can distinguish intellectual and industrial property rights for their economic and market value. Intellectual property designates special rights that have authors, inventors and other intellectual property holders. Thus, intellectual property is not a material property of some subject, but the right or the set of authorizations recognized by the legal order of the country to the intellectual property owner. Croatian legal theory prevails in the division of intellectual property rights on copyright and copyright related rights on the one hand and industrial property rights on the other. A joint stock company that invests intellectual property rights into share capital gains greater advantage over the competition.
