ZPP-a. |
Sažetak (engleski) | The preparatory hearing precedes the main hearing where the previous procedure is concluded, and a date for the main hearing is scheduled or the main hearing is immediately conducted. Consequently, the shortest deadline within which the parties prepare for the main hearing is determined. The consequences for the absence of parties from the preparatory hearing are not prescribed by the valid Law on Civil Procedure (hereinafter: ZPP), except in cases of disputes of minor value, provided that the conditions of Article 465 of the ZPP are met. If there are impediments to further proceedings, the task of the preparatory hearing is to remove the impediments and organize the material for the main hearing. Since the lawsuit has been received, preparations for the main hearing are carried out. These preparations include preliminary examination of the claim, service of the claim to the defendant for response, holding of the preparatory hearing, conclusion of the previous procedure, and scheduling of the main hearing. Appeals against decisions made by the court during the preparation for the main hearing, concerning the management of the proceedings, are not allowed. After receiving the lawsuit and the response to the lawsuit, but before holding the first hearing, the court may call on the parties to provide written comments on the opposing party's allegations. The deadline for parties to provide written comments on the opposing party's allegations is determined by the court and cannot exceed 30 days. In accordance with the principles of adversarial procedure, the preparatory hearing is conducted publicly, starting with the presentation of the claim followed by the defendant's response, and the court may, during the preparation for the main hearing, render a judgment based on admission, judgment by default, judgment by default for failure to appear, judgment without holding a main hearing, and record the parties' settlement. |
